Libel vs. Slander vs. Defamation – What Are The Differences?

WHAT IS DEFAMATION?

WHAT IS LIBEL or SLANDER?

The term defamation refers to the harming of your  reputation by anyone who or any entity which makes any false written or oral statements about you to a third party.

Defamation law protects your reputation from unjustified attack. Any person who tells lies about you to other people is probably defaming you and you could sue for damage to your "good name."

Defamation includes libel and slander and is generally, whether written or spoken, any intentional false communication that harms a person's reputation or decreases the respect, regard, or confidence in which a person is held or induces disparaging, hostile, or disagreeable opinions or feelings against a person.

DEFAMATION MEANING: The act of communicating false statements about a person that injure the reputation of that person. In a defamation law suit a claim must generally be false and have been made to someone other than the person defamed.

SLANDER MEANING: Slander is any spoken, oral,  defamatory statement. It is the action of making a false spoken statement damaging to a person's reputation.

LIBEL MEANING: Libel is a written defamatory statement. Libel is the act of publishing a statement about someone that is not true and that gives a bad impression about the person.

Section 5(1) of the Libel and Slander Act specifies you must  formally notify the other party that they have defamed you within a few weeks or lose the right to sue forever.

Service must be made by serving them in the same manner as serving a statement of claim. Failure to properly serve will prevent you from suing.

THE PURPOSE OF THIS NOTICE requirement is to give a defendant an independent opportunity to issue a retraction, correction, withdrawal or apology for allegedly defamatory statements, thereby mitigating potential damages.
