How to Complain
Over the last 15 years, LSUC has admitted almost 17k more lawyers to practice than have retired (bringing the total to almost 48k lawyers). If paralegals are included, the number of licensees rises even higher.
This means that by the end of 2014, Ontario had 1 lawyer for every 288 residents.
Against this backdrop, LSUC wants to allow more entrants (ABS) into the legal services market.
This comes at a time when the average Ontario lawyer earns around 80k, which is less than the average teacher (excluding Teachers' far superior benefits).
Step One: Insure a retainer sufficient to cover the most immediate and necessary steps is provided.
Step Two: Bill the client FREQUENTLY, so the bills are smaller and easier for the client to control, and monitor.
Step Three: Monitor the retainer diligently. When it drops below a level that will cover the next anticipated steps, request additional funds. If they are not forthcoming, cease services, render an up to date account, which should not have a large receivable if steps one and two are followed.
This way, clients are not stunned by "sticker shock" by receiving a large, unmanageable bill many months or even years after the initial retainer was obtained. Furthermore, the lawyer will avoid doing a large amount of work without pay. Instead, there may be a small balance owing at the end of services that the lawyer may be ready to discount or write off, in light of the prior fees already paid.
This is easier said than done sometimes, but, when followed, invariably avoids the high collectible scenario.
Canadian politically correct culture and our legal system live in an Alice in Wonderland world, where power, not justice, is the point:
